I'll say 100% biker. Reason being that -

1) It's a narrow country road - and you just don't know what's going to happen next.

2) He (She?) should have been able to see the car that had pulled in.

3) There's an obvious passing place on the left - which is where the tractor was heading when it began to reverse.

4) The biker pulled up way too close to the tractor. The old saying holds true - if you cannot see the mirrors then don't expect the driver to be able to see you.

I think that covers it.

I also agree with the others, rider way too close to the trailer to make a safe decision on road position.

Don't you consider the following relevant?
  • The tractor driver should have noticed that a vehicle was following. It's called 'observation'.
  • The tractor mirrors should have been adjusted to allow the driver to detect that a vehicle was following (even if it was only where the road curved).
  • Before a vehicle begins to move, it is the responsibility of the driver to ensure it is safe to do so.
  • The tractor driver made no attempt to check whether it was safe to reverse.
  • The tractor driver could have reversed more slowly, ideally at less than a walking pace, to give people a chance to get out of the way.

Rider was too close when stopped, they could of dived down the lane to left otherwise, lorry driver should of checked it was clear (i actually couldn't see any reversing lights) might just be me,
Loved the sound of the dying horn at end of clip
hope the rider was ok

Both at fault.

Tractor/ fastrac ? driver going too fast, should have pulled into that wee lane on the left, was he empty ? think so by the way he stopped pretty abruptly.
Bike rider driving a city boy attitude in a country environment. He saw that land rover miles away, he could easily have stopped in time, if he couldn't, he should have jinxed up thon wee lane.
You have to remember, these fastracs can fairly motor on, not like the days of the wee grey fergie :)

despite the fact that the motorcycle rider was at fault for being too close... ultimately its the tractor drivers responsibility to check that its safe to reverse and it wasn't.
